There are already 18 bills in Congress that seek to authorize a seventh withdrawal of private pension funds. This time, parliamentarian Edgard Reymundo, from the Democratic Change – Together for Peru bench, entered into documentary processing a new legislative initiative that proposes to release, on an optional basis, up to three Tax Tax Units (UIT) of the money accumulated in Individual Accounts of Capitalization (CIC) of AFP affiliates.

New targeted withdrawal project for 3 UITs: who would access it?

According to the explanatory memorandum of Bill No. 6289 by Congressman Edgard Reymundo, the objective of this proposal is to authorize a withdrawal of up to 3 UIT of the total funds of AFP affiliates, since “many people “They need their money to generate an independent business and recover the increase in pension contributions.”

“We must consider that the contributions made by each worker converge their efforts during their life and that, considering their age, the economic situation in which they find themselves and the health situation that afflicts them, it is necessary to make use of their contributions as a right, that will allow them to overcome and/or address the critical needs that afflict them,” reads the legislative proposal.

In that sense, article 2 of the bill establishes that the members who would access this withdrawal would be:

  • Members unemployed for six continuous months.
  • Affiliates unemployed for approximately twelve months accumulated, during 2022 and 2023 as of the date of issuance of this law.

Targeted retirement project for health reasons

The bill by Congressman Edgard Reymundo, from Cambio Democrático, emphasizes the limitations that contributors have to withdraw their money from the AFP in the event of a medical emergency. In this sense, its scope is considered an opportunity for citizens with oncological and terminal diseases to request the disbursement of their private pension funds due to the lack of resources and poor provision of health services.

That’s why, Article 3 of the legislative proposal authorizes the extraordinary release of 95% of the fund of the Individual Capitalization Accounts in a single withdrawal to members who are contributing or not and who suffer from oncological diseases, or those with a serious or advanced pathological condition, diagnosed by public and private health entities. “In this case, the total disbursement will be made 30 days after submitting your request”reads in Bill No. 6289.

How would the AFP withdrawal be carried out, according to the new project?

According to article 4 of Congressman Reymundo’s bill, the extraordinary withdrawal of funds would be carried out in this way:

  • Affiliates submit their request virtually or in person and, only once, within sixty (60) calendar days after the regulations of this law come into effect.
  • 2 UIT, equivalent to S/9,900, will be paid in a single withdrawal and 1 UIT (S/4,950) 30 calendar days after the first deposit. Along these lines, the first disbursement will be made 30 calendar days after the request is submitted to the AFP to which the beneficiary belongs. affiliate.

New 3 ITU targeted retirement project: what other aspects should be considered?

In accordance with article 5 of the targeted retirement bill for unemployment and 95% for health reasons, the release of funds maintains the status of intangible and should not be subject to discount, legal or contractual compensation, seizure, withholding, or from any form of affectation, whether by judicial or administrative order, without distinction of the account in which they have been deposited.

Finally, the Superintendency of Banking, Insurance and Private Pension Fund Administrators (SBS) determines through regulations the operating procedure within a period that will not exceed 15 calendar days from the publication of the law, under the responsibility of its owner.
