On November 1, the former Minister of Production, Foreign Trade, Investments and Fisheries, Julio José Prado, reported through his X account (formerly Twitter) that the Free Trade Agreement (FTA) was approved by the CC and is now the next step for the executive to send the instrument to the National Assembly for analysis and approval.

The trade agreement between Ecuador and China was signed on May 10 and after that this instrument went to the CC, where they reviewed the conditions so as not to violate the constitutional norm. After this step, the Constitutional Court determined that legislative consent was required before ratification by the President of the Republic, for which it ordered the publication of the full text of the contract in the Official Register.

The publication was completed on August 28, and citizens could intervene within ten days to defend or dispute the partial or complete constitutionality of the ZST in which they were represented. amicus curiae for and against, and after that the CC issued the ratification of the agreement and in order for it to enter into force, it must be discussed in the National Assembly.

The exporters’ union indicated that it was informed of the positive opinion issued by the CC regarding the text of the free trade agreement. “This decision is based on the conclusion unanimously adopted by nine constitutional judges in the opinion signed on October 30 and November 1 of this year,” they emphasize in the press release.

Cordex reminded that “it is an active manager in this process and recognizes the judgment as an important progress in promoting the trade of Ecuadorian products with the Asian giant. In this sense, he hopes that when the National Assembly positions itself, it will be one of the priority issues that should be resolved in order for it to come into force as soon as possible.

Citing Article 120, paragraph 8 of the Constitution, Cordex indicated that after the CC’s approval, it is now up to the executive to send the text of the contract to the National Assembly, the body that “will have responsibility for reviewing and deciding on its approval or disapproval.” “.
