Bill to increase days of paternity leave advances in Congress

The Women’s Commission of the Congress of the Republic approved this Friday bill 3317/2022-CR, which increases the days of paternity leave for workers in the public and private sectorswith the aim of “promoting the right of the newborn to paternal assistance.”

The initiative of Congresswoman Rosangella Barbarán modifies articles 1, 2.1 and 2.2 of Law 29409, which grants the right to paternity leave to workers in public and private activity, increases the calendar days of leave from 4 to 20 in cases of natural birth or cesarean section.

There will be exceptional deadlines. The leave will be 30 consecutive calendar days for premature births and multiple births, 35 days for births with terminal congenital disease or severe disability, and 35 for serious complications in the mother’s health.

In addition, it incorporates a fifth article in which it specifies that the Social Health Security (EsSalud) or the Health Provider Companies (EPS) where the working father is affiliated “will assume the cost of the days of paternity leave, as appropriate.”

It should be noted that, at this time, there are other bills to increase the days of maternity leave from 90 to 126 for the last stage of pregnancy, childbirth and the postpartum period.

The device regarding paternity, presented by the Fuerza Popular bench, will still have to pass the filter in the Labor and Social Security Commission before seeing the light in the Plenary Session in the current legislature.

This is where it could get stuck, since it has been accumulated together with bills 1330/2021-CR, 1934/2021-CR, 2127/2021-CR, 2890/2022-CR, 2948/2022-CR and 3514/2022 -CR.
