Lima Bus will have to pay a fine of S / 46 million for breaching contracts with the State

The Ministry of Transport and Communications (MTC) succeeded in having three arbitration tribunals declare the company’s economic claims inadmissible Lima Bus Internacional 1 SA

The legal defense strategy proposed by the MTC Public Prosecutor’s Office, in collaboration with the technical team of the Urban Transportation Authority (ATU), prevented said company from failing to pay the State a total of S / 46 million 102 thousand.

Lima Bus Internacional 1 SA claimed to cancel this amount, despite the fact that it breached the concession contracts for the operation of the Passenger transport service through trunk buses and feeders in the High Capacity Segregated Corridor System – COSAC I (better known as Metropolitan)

Three tribunals issued arbitration awards declaring inadmissible the claims of nullity of four penalties applied to Lima Bus Internacional 1 SA for contractual breaches.

“The three arbitration awards favorable to the ATU will serve to strengthen the institutional position in other arbitrations in which the concessionaire companies question, with requests for annulment, the penalties applied for contractual breaches,” said David Ortiz Gaspar, public attorney of the MTC.

MTC: Construction Club

A few weeks ago, the Public Prosecutor’s Office of the MTC also prevented the State from disbursing S / 2 million 537 thousand 568 in favor of the Queiroz Galvao company, investigated by the case of the ‘Construction Club’.

The defense strategy proposed by the Public Prosecutor’s Office team, chaired by David Ortiz Gaspar, prevented the aforementioned construction company from obtaining economic advantages due to extensions of the term of the rehabilitation and improvement work of the Yauri-Negromayo-Imata highway, Section : DV Imata – Oscollo – Negromayo, located between the regions of Arequipa and Cusco.
