This fund can be used by the worker in the event of dismissal and, in addition, be withdrawn until December of this year. However, little is known about the reason why this amount can be seized.

In what cases can my CTS money be withheld or seized?

According to the Lima Chamber of Commerce (CCL), a worker’s CTS can be seized when he has food debts of up to 50%. It is important to highlight that this payment is deposited in the bank of your choice, even when there is a judicial seizure for food.

In this scenario, the company is responsible for notifying the judge that the CTS has been deposited with the deadlines established by law, and that the seizure must be requested from the depositary bank.

According to the National Superintendence of Labor Supervision (Sunafil), companies have a deadline of Wednesday November 15 to deposit the Compensation for Time of Service (CTS).

What happens if my company does not deposit the CTS?

Sunafil informs that if the employer does not deposit the CTS, the worker can file a complaint in his virtual platform. However, that is not all: a fine is imposed that will depend on whether the company is micro, small, medium or large; Therefore, it can vary between S/554 and S/129,294.

If the company does not provide the sheet with the CTS calculation to the collaborator five days after the deposit, they may also receive a fine, but a lighter one: from S/222 to S/76,824.
