November is approaching and with it the deadline for formal workers to receive the Compensation for Time of Service (CTS) deposit expires, a benefit granted by micro, small, medium and large companies twice a year to establish a fund that helps face a possible dismissal or resignation.
Until this year, the worker can withdraw his entire CTS if he wishes. In the following note, we detail the deadline that your company has to deposit this benefit and what you can do if it does not do so.
Until what day can they deposit the CTS?
According to the National Superintendence of Labor Supervision (Sunafil), the deadline for companies to deposit the Compensation for Time of Service (CTS) is Wednesday, November 15. During the year, this benefit is deposited twice: in May and November.
What happens if my company does not deposit the CTS?
Sunafil indicates that if a worker does not receive his CTS You can make a complaint in your virtual platform. In addition, it is possible to establish a fine, and the amount will depend on whether it is a micro, small, medium or large company, but it can range from S/554 to S/129,294.
If the company does not comply with delivering the sheet with the calculation of this benefit five days after making the deposit, it may also receive a slightly lighter fine ranging from S/222 to S/76,824. It is important to mention that the amount of the fine depends on the number of affected workers and is based on the ITU (S/4,950).
CTS 2023: until what date can I withdraw my money?
The last day to withdraw 100% of the CTS is December 31, 2023, as established in Law No. 31480, which was published on May 25, 2022.
