How to file a claim for excessive charging for water service via Sunass?

In Peru, the drinking water service is controlled by companies such as Sepadal, which is why a claim is often made to the supplier; However, we are not always happy with the response they may give to our complaint. Thus, the National Superintendency of Sanitation Services (Sunass)the entity in charge of establishing standards, regulating, supervising and supervising sanitation services, has the obligation to help, in a second instance, users so that they can receive a better or more complete response to their request.

How to submit a claim to Sunass?

Sunass, according to its web portal, recommends, in principle, making a first claim with the company that offers the drinking service. Users have up to two months or 60 calendar days from the expiration date of their bill to make the claim, and the ideal is to present it before the expiration date of their second bill, thus avoiding the risk of a service outage. .

If after this process there is no compliance on the part of the user with the response to their claim, they must request, within a period of 15 business days, an appeal through form number nine or a virtual form on the website of the company providing sanitation services. Thus, add a supporting document or whatever you consider necessary, such as photos and/or videos.

At this stage, the claim will be submitted to Sunass with the file of everything that has been done and it will be the Administrative Tribunal for the Resolution of Claims of Users of Sanitation Services (TRASS) of said organization who will resolve the controversy within a period of 35 business days, in the second and last administrative instance.

Likewise, you can go directly to Sunass to present the claim in the second instance through its website. On the portal you can find the option “provider companies – second instance claims”, where you can appeal the response that your drinking water server gave you.

This complaint must be presented by the person who is a user of the service, whether it is the owner of the place or the one who rents (through the rental contract). If it is a problem that affects a multifamily building, the claim can be made by the representative of the owners’ association through the company’s website. If the complaint is made in person, a written statement must be submitted with the claim and the signature of 50% plus one of the number of users who live in the building.

Within the platform you will find a form that you must fill out with a series of data and evidence such as the copy of the receipt that you want to claim, the first response from the company, the payment history of the receipts, and etc., in addition to data that you can include in your claim.
