The Constitutional Court (CC) gave a positive opinion on the constitutionality of the Draft Organic Regulation on the Emergency Economic Law on Risk and Disaster Management, but with exceptions in some articles because they are not in accordance with the Constitution.

This opinion was approved by the Plenary Convocation of the Constitutional Court with nine votes for constitutional judges: Karla Andrade Quevedo, Alejandra Cárdenas Reyes, Carmen Corral Ponce (unanimous vote), Jhoel Escudero Soliz, Enrique Herrería Bonnet, Alí​​​​Lozada Prado, Teresa Nuques Martínez , Richard Ortiz Ortiz and Daniela Salazar Marín, in an extraordinary session on Thursday, October 5, 2023, but the sentence was announced on the night of Friday, October 6.

Provisions that are considered inconsistent with the Constitution are: Article 6, Article 11, paragraph four, number 6 – item a) ib) –, number 7 – point a) to e) –, number 8; Article 12.; article 13, paragraphs 7, 8 and 11; article 14, paragraph 1; reformatory provisions; general disposition.

On September 5, President Guillermo Lasso sent a decree on the law on the management of risks and disasters, together with a project for the balance, organization and transparency of public finances, but the latter was rejected by the CC as not in line with the Constitution.
