He Congress of the republic made official the law that establishes the regime for rescheduling the payment of pension contributions to the pension funds of the private system of administration of pension funds owed by public entities (REPRO AFP III), accrued until December 31, 2022, which were not canceled at the time.
The Law No. 31888, published today, Friday, October 6, in El Peruano, Its purpose is to protect the rights of workers so that they can access their pension rights, providing facilities to public entities to comply with the payment of pension contributions owed to the pension funds of the Private Pension System (SPP).
The Repro AFP III will be applicable to the specifications of the national government, regional governments, as well as local governments, which may request the rescheduling of their debt to the Administrators of pension funds (AFP), submitting your application for foster care, until February 28, 2024.
However, it is specified that those entities that accepted a debt from the rescheduling of debts with the SPP established in Legislative Decree 1275 and/or Emergency Decree 030-2019 will not be able to accept the same debt again from REPRO AFP III.
The duly updated debt, which is the subject of foster care, can be divided up to a maximum of 10 years. The installments involved in the fractionation may be subject to a minimum amount, fractionation interest, interest applicable to unpaid installments, causes of loss of the REPRO AFP III benefit, among others. If the entities consider it appropriate and have the financial resources, they can advance the installments of the debt received, generating a reduction in the corresponding interest.
The Ministry of Economy and Finance has a period of up to 60 calendar days to regulate the standard. While the Superintendency of Banking, Insurance and Private Pension Fund Administrators will approve the necessary procedures for its implementation.
