CTS 2023: how much should workers who work in microbusinesses receive?

In just over a month, the deadline will expire for formal workers who are registered on payrolls to receive the deposit of the Compensation for Time of Service (CTS), a social benefit that is deposited twice a year and that is used to face future contingencies such as layoffs or resignations. CTS 2023: how much should I receive in November?

According to the Lima Chamber of Commerce, the amount of Compensation for Time of Service varies according to the type of company and the time worked in the semiannual period. Here we give you more details about it:

Micro and small businesses

A micro and small business (mype) is an economic unit formed by legal or natural persons, whose objective is to carry out marketing, extraction, production or service provision activities. If a business does not exceed 150 UIT (S/690,000), it will be considered a microenterprise. For its part, it will be called a small company if it does not exceed 1,700 UIT (S/7 million 820,000).

In the case of microbusinesses, there are three cases related to the payment of the CTS:

  • If the microenterprise is not registered with Remype, all its workers will have the right to receive the CTS under the general rule.
  • If the microenterprise was registered with Remype, workers hired before registration can receive the CTS payment under the general rule.
  • If the workers were hired after the microenterprise was registered with Remype, these collaborators do not have the right to the CTS.

In relation to small businesses, there are three other situations:

  • If the small company is not registered with Remype, all its old and new workers will be entitled to the CTS in accordance with the general rule that applies to medium and large companies.
  • If the small business is registered with Remype, workers hired before its registration may receive the CTS payment.
  • If the worker has been hired after the company registered with Remype, his CTS will be 50% of what is obtained in the general regime.

Medium and large companies

If a worker worked the entire semester, from May 2023 to October 2023, the CTS is calculated as 50% of the gross salary plus one sixth of the bonus received in July 2023.

CTS, November 2023: when do they deposit the amount?

According to the National Superintendency of Labor Supervision (Sunafil), companies have until November 15 of this year to deposit the Compensation for Time of Service (CTS)whose semester period is as follows:

  • From November 1 to April 30: May deposit
  • From May 1 to October 31: November deposit.

CTS 2023: how to calculate the amount I will receive?

If you want to calculate how much you should earn in November, you can use the La República calculator. Keep in mind that you must record various information such as the date you started work, gross salary and whether you receive family allowance. Let’s give an example in this regard. If you win S/1,500, the calculation would be as follows:

  • Remuneration to be considered: S/1,500
  • 1/6 bonus: S/250
  • The sum of both amounts is S/1,750, which is divided by 360 days and is equivalent to S/4.86
  • The amount previously obtained by the number of days worked (if you worked a full semester, it is multiplied by 180): S/4.86 x 180 = S/874.8
  • What you will receive from CTS would be S/874.8.

CTS 2023: until what date can I withdraw my money?

According to Law No. 31480, which was published on May 25 of last year, the last day to freely dispose of 100% of the CTS is December 31, 2023. After the date has passed, workers will not be able to access said money until they end their contractual relationship with their employer.

The CTS deposit is made twice a year. Let us remember that the first was already done in May and the second will become effective this November 15.

CTS 2023: how much is the fine for not making the deposit?

According to the Lima Chamber of Commerce, the National Superintendency of Labor Supervision (Sunafil) can apply fines for non-compliance by companies with the payment of the CTS, which are differentiated for micro, small, medium and large companies. Along these lines, they range from S/554 to S/129,294.

In the event that they do not deliver the settlement sheet with the calculation of this social benefit within five days of making the deposit, a minor infraction is established and the fine ranges from S/222 to S/76,824. It is relevant to mention that, to determine the fine, the number of affected workers is taken into account based on the ITU (S/4,950).
