Through supreme decree 214-2023-EF, made official this Wednesday, October 4 in El Peruano, the regulations of the General Sales Tax Law and Selective Consumption Tax so that the sale of metals from mining producers to national jewelry manufacturers is considered an export of goods.
It should be added that they will have this label as long as the jewelry is destined for export, and both businesses will have to comply with the requirements of the regulation, such as not having been qualified by Sunat with the two lowest levels of tax compliance.
According to the regulations, this figure will come into effect on the first calendar day of the month following its publication in El Peruano.
In addition, the jewelry manufacturer benefiting from these changes must present an input-output report to prove that the metal sold by the mining producer was incorporated into the exported product.
It will be in the hands of the Sunat control and supervise the data contained in these reports, although you may request Produce to prepare a verification report.
