Telefónica will not be able to contract with the State for three years

The court of the State Procurement Supervisory Body (OSCE) disqualified Telefónica del Perú to contract with the Peruvian State for a period of three years. This, after said entity declares the reconsideration appeal filed by the company unfounded and ratifies the sanction in all its aspects.

In accordance with the OSCE resolution, the telecommunications company presented inaccurate information and false documentation or adulteration of a worker before the Ministry of Labor and Employment Promotion (MTPE) within the framework of an award for the ‘Contracting of automatic reverse charge telephone service’.

In response, the multinational alleged that the worker involved was fired and criminally charged.

Likewise, they indicated that they satisfactorily provided the connectivity service required by the MTPE. “The service provided did not cause any harm to the Peruvian State. The amount contracted with this institution was S/100,000.”

Legal actions

Given the unfavorable ruling, Telefónica announced that it will take the necessary actions before the Judiciary to reverse said sanction, which they consider to be disproportionate.

“The resolution issued by the OSCE State Contracting Court, which temporarily disqualifies the company from contracting with the State, is totally disproportionate in relation to the events that occurred,” the company said in a statement.

The Republic learned that Telefónica filed an amparo action requesting a precautionary measure to avoid the OSCE measure.

Impact. The decision of OSCE It does not affect the commitments assumed by Telefónica in the contracts it has entered into with various public entities, which ensure that they will continue to be fulfilled under the same conditions. However, it does prevent the telecommunications company from participating in new projects with the State.
