The State Contracting Supervisory Body (OSCE) disqualified Telefónica del Perú from contracting with the Peruvian State for a period of 36 months. Although this decision will not affect current contracts with public entities, it does prevent the company from participating in new projects.
Given this decision, the telecommunications company has stated, through a statement, that it will take the necessary actions before the Power of attorney to “reverse this disproportionate sanction.” According to close sources, Telefónica del Perú presented an amparo action that requests a precautionary measure, in order to reverse the OSCE measure. However, they point out that they respect the rule and will abide by what the authorities indicate after the appeal.
“The resolution issued by the State Contracting Court of the OSCE, which disqualifies the company from contracting with the State on a temporary basis, is totally disproportionate in relation to the events that occurred,” the company said.
The origin of the sanction is due to the fact that the OSCE identified that one of the people involved in a Telefónica project provided to the Ministry of Labor and Employment Promotion (MTPE) had provided false information about their academic degrees. However, sources close to the company state that as soon as this was detected, they proceeded to fire the person and report him criminally. Likewise, they specified that the service was carried out 100% without the participation of the personnel involved.
“Telefónica satisfactorily provided the connectivity service required by the Ministry of Labor and with all the obligations established in the contract signed with said institution. The service provided did not cause any harm to the Peruvian State. The amount contracted with this institution was S/100,000“added the company in its statement.
It is important to point out that the resolution of the OSCE It is in the second instance, therefore, the administrative route is exhausted and the file was archived.
