The legal decrees that President Guillermo Lasso sent to the Constitutional Court did not have the response the Government expected: only two were approved, three were rejected and two are awaiting a decision. But citizens, businessmen, political actors and trade unions responded to give their contribution with their views for and against expressed in almost 80 amicus curiae on these decree laws, which shows that there is interest from the sectors involved, according to analysts.

According to the records of the Constitutional Court, there are at least 76 of them amicus curiae they presented different organizations for the seven projects that Lasso sent after he applied the death of the cross that dissolved the National Assembly last May.

The regulation on risk and disaster management has a greater chance of passing the control of the Constitutional Court than the control of public finances

The two decrees that had the most views of civil society are those that were approved: Strengthening the family economy, which contemplated tax reform and was the first to be sent after the death on the cross and received the confirmation of the Constitutional Court; for that law it was 24 amicus curiae. While 15 of these documents were presented for the creation of a refundable tax on non-returnable PET plastic bottles; This decree-law received a positive opinion on September 19.

The decree on free zones also aroused wide interest: 16 persons or groups presented their arguments for and against before the Court. This proposal did not pass the constitutional review. As well as the business restructuring (13 amicus) nor that of financial support in favor of co-activated users of educational loans, scholarships and financial aid (1).

The court still needs to resolve the latest projects sent by the executive: for the balance, organization and transparency of public finances, which currently has 6 amicus curiae, and Risk and Disaster Management, which has one.

The different positions expressed by the organizations on the decrees sent by the executive “obviously” show that there is an interest of the sector to participate, according to economic analyst Segundo Camino Mogro.

It indicates that the constitutional and legal creation needs the help of citizens, who will, in principle, express themselves about those decrees that they really believe “can significantly help them or significantly worsen their position”.

These are the tax changes that will occur with the first legal decree issued after the death of the cross

Under this argument, the United Workers’ Front (FUT) presented a amicus curiae against the decree on the law on the balance, organization and transparency of public finances, since he considers that it is not an economic emergency and that “this project proposes that the payment of interest on the historical debt to social security be unknown, which exceeds 3,500 million dollars, with regard to the payment of 40% of the payment of pensions which by law answer to the national government,” said the national vice president of the General Union of Workers of Ecuador (UGTE), Eduardo Ortega, which is part of the FUT.

In addition, he says, it is proposed to reduce the percentage for education and health. He believes that “the intention is for the catastrophically ill to remain unprotected, because they would not have 100% coverage, but only 23%”.

Camino Mogro points out that this decree law “leaves much to be desired, in the sense that it begins or plans to reduce the amount of public funds that can be allocated to health and education; There is even talk of non-payment of some social issues. So you have to be very careful with it.

Guillermo Lasso announces the fifth attempt to pass a decree law, this time to keep the redemption tax on plastic bottles in place which favors those who recycle

The Constitutional Court gives way to passing laws that meet the urgent nature of economic issues.

The analyst points out that the Supreme Court was right to reject the Regulation of the Law on Attracting and Encouraging Investments for Productive Development, because it was not a short-term law, since attracting foreign investment takes a long time, and in the current situation it should be considered an election period.

He also mentions business restructuring, because regulations of this type are not implemented in a short period of time. “This does not mean that, since we adopted the law on company restructuring today, in two months we will solve the problem of companies that are highly indebted and that do not generate employment and business dynamics.”

The economy assesses the verdict of the Constitutional Court against the decree of the law on company restructuring as a ‘mistake’

For him, such laws should be dealt with by the new National Assembly based on what the new president of the Republic of Ecuador wants.

However, he indicates that the Constitutional Court should “take into account the regulation of the law on natural phenomena, because of this whole problem that will be caused and that has already been caused by the issue of the El Niño phenomenon.”
