The Specialized Chamber for Consumer Protection of the indecopi sanctioned the companies Supermercados Peruanos SA (Vivanda, Mass and Plaza Vea), Mayorsa SA (Mayorsa and Maxi Ahorro) and Hipermercados Tottus SA (Tottus) for selling canned products with bumps and dents in their commercial establishments in Lima and Callao. The punishment is final because it was resolved in the second and last instance. This was after the complaint filed by the Peruvian Association of Consumers and Users (Aspec).
What were the penalties?
For Mayorsa, Maxi Ahorro and Tottus, fines of 15 UIT were imposed on each of the companies. On the other hand, Vivanda, Mass and Plaza Vea have achieved the annulment of their sanction; however, the first instance will have to recalculate it. This is because they failed to comply with article 30 of the Consumer Protection and Defense Code, which indicates that suppliers are responsible for the safety of the products.
In addition, these companies were ordered to take the necessary measures to prevent it from happening again and, in the event that beaten or dented canned products are detected, they are withdrawn. If they do not comply with this, they may be fined additionally by Indecopi.
