Holiday August 30: those who telework must also receive triple pay, according to Sunafil

The holiday August 30 is approaching, the date on which the Saint Rose of Lima’s day. For this reason, the National Superintendence of Labor Inspection (Sunafil) reminds private employers that they must make a triple payment to those who work that day.

This payment must be made as long as the workers do not enjoy the rest day in compensation for the day worked.

The three remunerations are based on a remuneration for the holiday, a remuneration for the work you do and a surcharge of 100%. In this sense, if the employee receives S / 50 for a day worked, at the end of the month he must receive an additional S / 100, since the first daily salary is already included in his monthly salary.

How much is the fine for non-compliance?

Workers who are in the teleworking modality also have the right to agree with their employer on a substitute day of rest or a triple payment for work on a holiday.

Failure to comply with the provisions related to paid breaks on holidays is considered a very serious infraction in terms of labor relations.

The fines are as follows: if it is a microenterprise, the fine ranges from S/1,138.50 to S/3,366.00. If it is a small business, the fine is established between S/3,811.50 and S/37,867.50. And if it is not an SME, the fine will be considered between S/13,018.50 and S/260,023.50.

Workers who detect that their employer has not complied with triple pay or granting a day off, can go to Sunafil or make virtual complaints by visiting the website: www.gob.pe/sunafil.
