Gratification 2021: how to calculate the payment that I will receive in December?

This December 15 expires the deadline for private companies to deposit the Christmas bonus to their workers, a labor law that consists of an additional payment added to the monthly remuneration of the employees and It is delivered for National Holidays and Christmas every year, as established by Law No. 27735.

That is why, before the income of this additional money, below, we will tell you what is the amount that you should receive this month for the payment of said concept.

When will I receive the Christmas bonus?

Keep in mind that companies have until December 15 to deposit the bonus for Christmas 2021.

Who gets the end of the year bonus?

The Lima Chamber of Commerce (CCL) points out that this labor benefit corresponds to workers with an indefinite, fixed-term and part-time contract.

Employees must have worked at least a full month between July and December of this year.

As regards workers in small companies, the regulations establish that those hired, after the company is registered in the Registry of Micro and Small Companies (Remype), will receive half a salary for the concept of gratification.

The workers of the microenterprise who were hired before it enrolls in Remype are also entitled to the Christmas bonus.

Along the same lines, to domestic workers are also entitled to this labor benefit. Law 31047 indicates that the amount is equivalent to a full salary.

In the case of the workers of the Agrarian Labor Regime, are entitled to the end-of-year bonus provided they have communicated to their employer their desire to receive the money in a semi-annual disbursement. Otherwise, this concept is paid together with your daily remuneration.

How do I know how much I will receive in bonuses this end of the year?

The Gratuities Law No. 27735 It specifies that the amount assigned for this concept must be equal to the worker’s full salary, without any discount, if he worked the entire semester from July to December and is working on the date the deposit is made.

In this regard, Mauricio Matos, Associate Partner of the EY Peru Labor Area, specifies that in the event that the employee has worked more than a month and is not working on the date of payment of the bonus, “It will correspond to receive a proportional bonus based on the months worked between July and December.”

How is the bonus calculated?

For the calculation of the bonus amount, it is taken into account the last gross salary the worker received. To this, an extraordinary bonus of 9% is added if you contribute to Essalud or 6.75% if you are affiliated with a Healthcare Provider Company (EPS).

If the employee did not work the entire semester, the bonus will be equal to one sixth of their remuneration for each month worked, explains the CCL.

For its part, EY Peru indicates that in no case are non-remunerative items (utilities, food benefits, mobility subject to attendance at the workplace, among others) included in the calculation, nor are working conditions, which are necessary for the provision of the service.
