This Sunday, July 23, Peruvians will have a new national holiday. This is an important date to recognize the sacrifice of the captain of the Peruvian Air Force (FAP) José Abelardo Quiñones during the war with Ecuador in 1941, as established by Law No. 31822 approved by Congress. After the publication of this norm in the newspaper El Peruano, many people wonder how much they should be paid if they work on this day off or rest. Next, we will clear up these doubts in the following note from La República.
Holiday of July 23: how much should I be paid if my rest falls on a holiday?
In addition to the traditional holidays that take place on July 28 and 29 within the framework of the National Holidays, this Sunday the 23rd we will have a new day off. In this regard, the manager of the Legal Center of the Lima Chamber of Commerce, Álvaro Gálvez, stated in a press release that this break is mandatory and private sector workers who do not work that day will have a simple remuneration and not an additional one.
Holiday July 23: If I work, how much should I get paid?
If you work in person or through virtual media on July 23, you are entitled to a triple payment. According to Álvaro Gálvez of the CCL, if the employee works this Sunday and a substitute rest date is not agreed with his superior, he must receive a remuneration equivalent to one day and the salary with the surcharge of 100% for the work carried out.
For example, if the employee’s monthly salary is S/1,500 and he provides his services on Sunday, July 23 without the possibility of obtaining substitute leave, the amount he will receive must be calculated as follows: S/50 for Sunday (holiday), plus S/100 for the work done (surcharge of 100%), which means a total of S/1,600.
Holidays: how much should I be paid if it coincides with my day off?
If a holiday falls on the same day of weekly rest, both overlap, according to the information provided by the Ministry of Labor. In this sense, it is equivalent to a single day of rest and therefore, the worker receives a single daily payment. The only exception to the rule is Labor Day, in which case, if it coincides with the day an employee rests, they will receive a remuneration of two daily payments: for the holiday and the weekly day of rest.
For example, if your monthly salary amounts to S/1,500, its daily value is S/50, so the worker should receive a total of S/1,550.
What are the remaining holidays for this 2023?
- July 28 and 29: National Holidays
- 6th August: Battle of Junín
- August 30th: Santa Rosa de Lima
- November 1st: All Saints Day
- December 8: Immaculate Conception
- December 9: Battle of Ayacucho
- December 25th: Christmas.
