As had been anticipated, this Friday, July 21, Supreme Decree No. 008-2023-MIDAGRI approved and published the regulation of “Law No. 31335, Law for the Improvement of the Association of Agricultural Producers in Agricultural Cooperatives”, which aims to strengthen the association of producers in agricultural cooperatives.
Likewise, it will promote the productive activities of more than 200,000 agricultural, livestock and forestry partners in the national territory, and It will favor around 500 communal agricultural cooperatives managed by 150,000 families, with approximately 360,000 cultivated hectares.
It should be noted that said regulation consists of 10 chapters, 46 articles, six final complementary provisions, eight temporary complementary provisions and two amending complementary provisions.
“The implementation of the provisions of this Supreme Decree and the Regulations are financed from the institutional budget of the documents involved, without demanding additional resources from the Public Treasury”, can be read in the decree, which is endorsed by Alex Contreras, Minister of Economy and Finance, and by Nelly Paredes del Castillo, head of the Ministry of Agrarian Development and Irrigation.
Main benefits
This law facilitates a special tax regime of exemption from Income Tax for cooperative acts. Likewise, it installs a protection regime for partners with a reduced rate of 0% for net income of up to S/148,500.
The National Council of Agrarian Cooperatives (Conaca) will also be implemented, a body in charge of the coordination, planning, promotion and investigation of the agrarian cooperative activity.
“It will be a public-private space for the construction, analysis and formulation of proposals and strategies, which facilitates the sustainable and competitive development of the agricultural cooperative model, in favor of the inclusion of agricultural producers,” said Paredes.
The norm also provides that the dependencies of the Agrarian and Irrigation sector and the regional governments prioritize mechanisms and instruments for the promotion of agricultural cooperatives, which will result in higher income for small producers.
Another important aspect is the participation of women in the board of directors of the cooperatives. A plan has been established to allow a number of women to be included in government bodies in order to reach, within a period of five years, a proportional level of skilled partners that make up the membership.
