He Supervisory Agency for Private Investment in Telecommunications (Osiptel) will be empowered to impose fines of up to S/4 million 950,000 (1,000 UIT) to the operating companies for non-compliance with the rules applicable to the provision of public telecommunications services and the obligations contained in the concession contracts.
The new Law 31839, published this Tuesday in the Official Gazette El Peruano, modifies articles 25 and 34 of Law 27336 on the development of the functions and powers of Osiptel and increases the amount of sanctions for administrative offenses classified as very serious, serious and mild. It had been approved on June 22 in Congress.
From now on, the offenses mildwhich were previously sanctioned with fines of between 0.5 UIT and 50 UIT, will now be punishable by up to 100 UIT (S/495,000).
Similarly, violations seriouswhich were previously subject to fines of between 51 UIT and 150 UIT, will now be sanctioned with up to 500 UIT (S/2 million 475,000).
Finally, the fines very serious they will be penalized by Osiptel with fines of up to S/4 million 950,000 (1,000 UIT). In the previous scheme, they were only penalized with fines of between 151 UIT and 350 UIT.
Previously, Osiptel had warned that, in almost three decades, the sanctions against companies such as Telefónica, Claro, Entel and Bitel covered barely 0.09% of their operating income, so that “the income of the offenders was not affected by the fines and neither are their investment plans”.
