Fonavi: more than 300,000 would be out of payments

He constitutional Court (TC) not only reduced the State debt to the contributions of the workers, in its latest sentence referring to the case of the National Housing Fund (Fonavi), but also points out that it is possible to exclude those who benefited from these funds, thereby that around 328,000 fonavistas could be left out of the return of contributions, according to the National Federation of Fonavistas and Pensioners of Peru (Fenaf-Peru) alert.

The ruling —016-2021— indicates that “it is appropriate to declare the unconstitutionality of article 2 (of Law 31173) in the extreme that allows the possibility that be included in the return to various people, without evaluating whether they received any direct or indirect benefit from Fonavi resources.”

The Fenaf-Peru It maintains that with said decision the TC would seek to exclude from the return of contributions the borrowers of the Materials Bank, who live in places where sanitation and electrification works were carried out.

One party has already paid their debt and another is pending payment, but they would do so with the money owed to them. They specify that the home connection costs have already been returned by the workers through the water and electricity bills.

“A person who borrowed money from the Materials Bank: one, they lent him their own money; and two, that person paid his own money back with interest; so, what is the benefit there if they lent you your money? None,” he says. Jorge Millaunion leader.

On the other hand, they are concerned that the evaluation of who was benefited or not would remain in the hands of the Ad Hoc Commission, whose majority is held by the Executive, so that they could easily impose their criteria.

So this Thursday, July 20, the session will continue to define this point in controversy. The members representing the Fonavistas propose to vote on the points on which they agree so as not to further trap the return of contributions that has not yet started after two years of delays.

The data

Advance. In an extraordinary session on July 11, the Ad Hoc Commission decided that OTASS should replace EPS Grau in administration, a company that owes Fonavi around S/128 million, so that it can catch up on its payments.

The word

Jorge Milla, member of FENAF-Peru

“The only beneficiaries are the electricity and sanitation companies, which today generate profits on the investment of Fonavi resources, but not the Fonavista. That has to be clear”.
