More than S/33,000 million are owed by public entities and private companies to the Pension Fund Administrators (AFP). This corresponds to pension contributions not made despite having been deducted from workers’ salaries. Given this, the Superintendency of Banking, Insurance and AFP (SBS) has issued provisions so that the collection of these debts can be more efficient.
Thus, through SBS Resolution No. 02349-2023, improvements were incorporated into the judicial collection process carried out by the AFPs with the aim of alleviating the procedural burden before the Judiciary. Thus, only one collection process is established for employers who owe contributions to more than one Pension Fund Administrator.
To this end, the AFPs may designate a legal representative to be in charge of carrying out judicial processes cumulatively from the filing of the claim to the execution and/or fulfillment of the final judgment.
“The AFPs must guarantee, jointly, that the accumulated judicial process is carried out in accordance with the terms and procedures established in the regulations on the matter, which includes carrying out the corresponding procedural actions,” summarized the SBS through a statement.

Only in the private sector a total of 151,017 employers failed to deposit the contributions of 1,202,028 members to their pension fund.
