July 23 has been declared a mandatory national holiday for workers in the public and private sectors, in commemoration of the heroic sacrifice of FAP captain José Abelardo Quiñones Gonzales. Thus, we now have 16 national holidays on the calendar.
Law 31822, published in the official newspaper El Peruano on July 8, made this proposal official, which was promoted by the Congress of the Republic and which is added to the already existing holidays provided for in Legislative Decree 713.
In this regard, the Lima Chamber of Commerce (CCL) reported some details for private sector workers who work on that date, which this year will coincide with Sunday.
“For the majority of workers, Sunday July 23 is a mandatory weekly rest, therefore, in case of not working on that day, the worker will only have his simple remuneration; that is, no additional remuneration will be paid, as is the case with May 1, when it coincides with the mandatory weekly rest day”, explained the manager of the CCL Legal Center, Álvaro Gálvez.
However, it specified that, if the worker works the July 23thbeing mandatory rest, and a substitute day of rest is not agreed, the employer must remunerate it in the following way: the remuneration equivalent to one day, for the holiday, and the remuneration with the surcharge of 100% for the work done.
For example, if the monthly salary of a worker is S/1,500 and he works on Sunday, July 23, being his weekly rest day, and he does not have another substitute rest day, he will receive the following for that day: S/50 for the day holiday/Sunday (which is already included in the monthly remuneration) plus S/100 for the work done (surcharge of 100%). So you will perceive a monthly total of S/1,600.
