July is one of the months most anticipated by workers in the public and private sectors, since they will be able to receive the payment of gratification and Christmas bonus, respectively, according to law. However, many people confuse these two concepts, therefore, it is necessary to clarify these doubts. To better understand the differences between the two social benefits that vary according to the labor regime and find out who will enjoy this extra money, read the following note from The Republic. Who is entitled to receive the gratuity payment?
The gratuity is an economic benefit that is paid to workers of the private regime with an indefinite, fixed-term or part-time contract., during July and December. This labor right is recognized in Law No. 27735 and establishes that this concept represents an extra amount to your monthly salary.
In the case of employees who have worked the entire semester (from January to June) and who are registered in the monthly payroll, they will receive additional monthly remuneration and an extraordinary bonus of 9% (EsSalud) or 6 .75% (health provider company).
In accordance with the norm that regulates bonuses, companies must make their payment until Saturday, July 15. Otherwise, they could receive a fine ranging from S/544.5 to S/129,294, depending on the company’s labor regime.
Who is entitled to receive the Christmas bonus for National Holidays?
The Christmas bonus is delivered to officials and servants appointed and hired under the regime of Legislative Decree No. 276 and Law No. 29944. Likewise, they are included:
- University professors of Law no. 30220
- Health personnel of Legislative Decree No. 1153, permanent and temporary workers of the State
- pensioners included in the regimes of Laws No. 15117 and 28091, as well as Decree Laws No. 19846 and 20530
- staff of the Armed Forces and the National Police of Peru.
In accordance with article 7 of the Public Sector Budget Law for fiscal year 2023, the amount of the Christmas bonus for National Holidays will be S/300, so all beneficiaries can collect it through their bank accounts.
What is the difference between gratuity and Christmas bonus?
Both the gratuity and the Christmas bonus are economic benefits in favor of the workers. However, in the case of the first, only private sector employees who are on the payroll during July and December receive it. This represents full remuneration in addition to your salary, as long as you have worked from January to June.
On the other hand, the Christmas bonus is granted to public sector workers and pensioners of the ONP, which is equivalent to extra money of S/300.

Gratification 2023: what requirements must the worker meet?
The private sector worker must comply with the requirements established by the law that regulates the payment of bonuses. These are:
- Have a full month of work in the company, prior to the month in which the gratuity is due
- Being in compliance with their duties during the first fortnight of the months in which the gratuity is paid.
How to collect the Christmas bonus 2023?
If the worker meets the aforementioned requirements, he should know that the amount corresponding to the bonus is deposited in his bank account and this remuneration is delivered directly when the established date arrives.
In the case of ONP pensioners, they will be credited to their savings accounts at Banco de la Nación. For this, there is a delivery schedule for this additional payment according to the initials of their last names.
