The payment of the gratuity for National Holidays is close. Well, employers have until July 15 to make this deposit to their workers. However, since this date falls on a Saturday, the maximum term to deposit this labor benefit would be reduced to Friday the 14th, warned the economist Omar Azanedo.
“Payroll payments are carried out in the bank payment systems. Normally, these tools work for the employer on Saturday until noon. So, most likely, on Friday the 14th they are making their payments“, he comments.
The founder of Noncash highlights that the country’s labor force currently has approximately 5 million formal workers, of which around 4 million belong to the private sector. “Although precise data is not available, it is estimated that around 4 million workers could receive the bonus in the next fortnight,” he estimates.
For its part, the Chamber of Commerce of Lima (CCL) emphasizes that subordinate workers in private activity with an indefinite, fixed-term and part-time contract have the right to gratuity; because to receive this benefit it is not required that the worker has worked a minimum of 4 hours a day.
Meanwhile, the labor law specialist Ayme Limaco indicates that employees belonging to companies registered in the general regime must receive an amount equivalent to one salary, while those who work in small companies or are domestic workers will receive an amount equivalent to 50% of their monthly salary.
In addition, it emphasizes that along with the bonus, the 9% bonus must be paid if the worker is affiliated with Essalud or 6.75% if he is affiliated with an EPS.
Not paying is penalized
The Chamber of Commerce of Lima indicates that if employers do not pay the bonus for National Holidays until July 15, they commit a serious infraction and can be penalized with differentiated fines ranging from from S/544.5 to S/129,294according to the labor regime of the company.
The current labor fine scales were approved by DS 008-2020-TR. There are three scales of differentiated fines, the first for microenterprises (up to S/2,227.5), the second for small companies (up to S/22,275) and the third for medium and large companies (up to S/129,294). .
Likewise, the CCL specifies that to determine the amount of the fine, in addition to the size of the company, the number of affected workers is taken into account, considering the UIT of S/4,950 for the year 2023 as a base.
