The Ministry of Foreign Trade and Tourism (Mincetur) announced that the Court of Justice of the Andean Community (TJCAN) ruled in favor of the Peru in the lawsuit filed against Ecuador due to the application of higher prices to international land carriers of merchandise and passengers —including Peruvian drivers with foreign license plates— that transited through Ecuadorian territory.
According to the ministry, the resulting price differentiation caused Peruvian drivers to pay more for fuel, which affected the logistics cost of Peruvian trade and generated a loss of competitiveness for Peruvians compared to their Ecuadorian counterparts.
Following the ruling in favor of Peru, the TJCAN has ordered Ecuador, within a maximum period of 90 days, to take the necessary measures to put an end to this conduct considered contrary to the legal system of the Andean community.
“This sentence is excellent news for our country. Rest assured that Mincetur will continue to work in the necessary instances to protect companies, carriers and other actors in the foreign trade chain. We hope that the Ecuadorian Government complies with what is ordered by the TJCAN, with the aim of allowing our carriers to compete without discrimination and on equal terms”, declared the head of the sector, Juan Carlos Mathews.
The Mincetur indicated that the Peruvian position, in defense of national carriers, is based on the fact that the conduct adopted by Ecuador violates the principles of non-discrimination, national treatment, equal legal treatment and free competition, established in Andean decisions No. 837 , 398 and 608, as well as in article 4 of the Treaty of Creation of the TJCAN. These arguments were also highlighted in the court ruling.
“The international land transport service for goods and passengers is essential for the Andean integration process. Ecuadorian regulations have violated the right of our carriers to receive non-discriminatory treatment and no less favorable compared to carriers with Ecuadorian license plates”, added Minister Mathews.
It should be remembered that in April 2021 the General Secretariat of the Andean Community had already declared Ecuador in a situation of non-compliance with the community legal system.
