However, what happens when I discover that my employer has not paid the monthly contributions? According to labor expert Vanessa Velásquez, this is reportable and would cause the employer to be sanctioned for violating the employee’s rights.

“Failure to comply with this regulation would subject the employer to imprisonment, as established by the Constitution, for a period of one or three years and the closure of its premises or business in case the employer is a legal entity,” notes Velásquez.

Velásquez mentions that the roles of payment are proof of work, income tax returns and attendance records. “Those documents are what most relate to the employer’s evasion of payments to IESS, they can be copies or originals,” he says.

And he adds that another aspect to consider is that you must be connected to the social security system to claim your claim that the employer did not pay. The objection can be submitted as many times as necessary.
