Congress proposes that workers can take a voluntary sabbatical

This benefit could only be requested after 7 years of continuous work, says the legislative initiative.

the congressman Luis Picón Quedo (Podemos Peru) proposes that all workers in the public and private sectors subject to the labor regime of Legislative Decree 728 can access a voluntary sabbatical, prior agreement with the employer.

Bill 5299 specifies that the leave would be unpaid and would have the following characteristics: it is granted for 12 months from January 1 to December 31; It can be requested after 7 years of continuous work (consecutive or accumulated); is not subject to any type of condition for his return to the workplace (prior agreement between the parties); and the worker can only request this leave until August 31 of the previous year.

In addition, it would be added in article 12 of DL 728 that voluntary unpaid sabbatical leave is cause for suspension of the employment contract. The Executive Power would have a period of no more than 30 calendar days to regulate the measure.

The document indicates that the problem that is sought to be solved is that the possibility of that workers can take a prolonged break from the workload before the retirement or cessation period.

The legislative initiative was presented on June 8, 2023 and is already in the Labor Commission for its analysis and preparation of an opinion; then it can go to the plenary session of Congress for debate and voting.
