July is a key month for thousands of workers in the private sector, since they add extra money to their fixed income from the bonus payment. This labor and mandatory benefit reaches employees on the payroll who have an indefinite, fixed-term or part-time contract. According to Law no. 27735, the worker who has worked the full semester —from January to June 2023—, will receive the equivalence of a full salary (without AFP or ONP discounts)added to other remunerative supplements, such as 9% of the Social Health Security (EsSalud) or 6.75% of a Health Provider Entity (EPS).
What is the deadline for the bonus to be paid to you?
Article 5 of the bonus law indicates that companies must deposit this benefit until July 15. However, what happens if this date falls on a non-business day, that is, Saturday or Sunday? As the expert Jorge Carrillo Acosta explained to La República, the term in this case will be immovable.
“The maximum term to pay the bonus is this Saturday the 15th, not Monday the 17th of July. Paying the next business day applies to the Compensation and Time for Service (CTS) deposit, but not for the gratuity,” he clarified to this medium.
Gratification: what requirements must the worker meet?
The conditions that a collaborator to receive your legal gratuity are:
- Have worked in the company for a full month, prior to the month in which the gratuity is due.
- Being in compliance with their duties during the first fortnight of the months in which the gratuity is paid.
If you worked from January to June, you are entitled to receive the full bonus, that is, a full salary. If the employee does not have a current employment relationship on the date on which the benefit is due, but would have worked at least one month in the semesterwill receive the bonus in the form proportional to the months actually worked.
What happens if my company does not deposit my bonus?
According to the National Superintendence of Labor Inspection (Sunafil), failure to pay the bonus is considered a very serious infraction, therefore, if the worker You have already submitted your complaint to the company where you work and have not received any response, you can file a virtual complaint with the entity.
Companies are subject to penalties and fines. In the case of small companies, the amount can be up to S/22,275, while in medium-sized and large companies the penalty amounts to S / 129,294.
