Indecopi will promote the first collective consumer lawsuits before the Judicial Power

Julián Palacín, executive president of the Indecopi, announced the implementation of the next reform to the Consumer Protection System, which includes the first collective lawsuits before the Judiciary to compensate people who saw their rights as consumers affected.

In this line, the regulatory body will present before the Judiciary the first collective lawsuits so that they receive some type of compensation, for which the cases that have damaged the population will be evaluated in detail, especially in their life, health, safety and integrity. .

During the award ceremony of the National Future Inventors Contest, organized by Indecopi and the UPC, Palacín Gutiérrez stressed that, currently, a special team carries out a diagnosis of the Consumer Arbitration System (SISAC), in order to encourage between companies, micro-companies and entrepreneurs in general, the use of this conflict resolution mechanism.

“We must identify the gaps and adapt them to the reality of our population. This code is the basis of the system and so far in its validity there have been 24 modifications of improvements to this regulation; but, after 11 years of validity, it requires adjustments to reach all citizens equally ”, said the official.

Likewise, the head of Indecopi acknowledged that the institution, attached to the PCM, must improve its response times, for which alternative dispute resolution mechanisms must be strengthened in those cases where the conflict cannot be resolved.

“We seek a preventive approach rather than a sanctioning one; We must put the same rules and uniforms for everyone, in order to be able to access and stay in the market; contribute to the economic reactivation of MSEs, raise the levels of competition in the market, facilitating the access of new companies and guaranteeing fair competition ”, he said.

Indecopi: attention in Quechua nationwide

For her part, Ana Peña, director of the National Consumer Protection Authority of Indecopi, said that another of the reforms is to deepen the attention in consumer defense to all corners of the country, beyond the geographical factor and the language barrier .

“One of the reforms is to bring the system closer to all people, regardless of where they are and the native language they have, as well as to comply with the deadlines of the procedures and evaluate that other mechanisms for resolving conflicts between suppliers and consumers can exist ”, he remarked.
