Employers have until Saturday, July 15, as the deadline for the payment of the bonus to their corresponding workers for July of this year. Likewise, a bonus of 9% must also be delivered if the worker is affiliated with Social Security or 6.75% if the worker is affiliated with an EPS. The aforementioned percentages are applied to the amount of the bonus to be received.
“This benefit must be paid twice a year: in July for National Holidays and in December for Christmas,” added Aymé Límaco, a specialist in labor law.
Which companies are responsible for paying the gratuity?
According to the specialist, all formal companies must comply with depositing the bonus to their workers, but it also depends on the size of the company. In the case of workers belonging to companies registered in the general regime, they are entitled to an amount equivalent to one salary, while those who work in small businesses or are home workers, the balance will be equivalent to 50% of their monthly salary.
For those who work in the agrarian regime or under an annual comprehensive remuneration agreement (RIA), the free is incorporated into their monthly remuneration or in the fee paid each year.
In what cases can the employer withhold the bonus?
It is important to specify that no employer can reduce or discount the income of its workers, including the bonus, without the latter having given authorization or there is an agreement between the parties.
However, the company can withhold the payment of labor benefits in case there is a court order, as a result of a lawsuit for food, the specialist said.
How much is the fine for failing to pay the gratuity?
The National Superintendence of Labor Inspection (Sunafil) reported that it will impose sanctions on companies that do not make full and timely payment of bonuses to their workers.
For micro and small businesses, the fines will range from 0.045 Tax Units (UIT), which is equivalent to S/222.75, up to a maximum of 4.5 UIT (S/37,867.50).
On the other hand, for medium-sized or large companies, the penalty ranges from 1.35 UIT, which is equivalent to S/ 1,287.00, up to 22.5 UIT (S/260,023.50).
