Infringements and sanctions

Likewise, Quinde notes that the norm has provided that Indecopi has powers to oversee that all advertising complies with this new requirement.

“With the new provision, not only will it be possible to be subject to a sanction at the level of tax regulations, but also from the area of ​​unfair competition; situation that may be punishable from a reprimand to 700 UIT (S / 2 million 765,000) ”, he comments.

It is important to remember that, according to Article 12 of the Consumer Protection and Defense Code, Law No. 29571, commercial advertising of products and services is governed by the regulations contained in Legislative Decree No. 1044, which approves the Repression Law. of Unfair Competition.
