The Executive Power has until June 28 to promulgate the modification of Law 31557, which regulates the exploitation of games and sports betting at a distance, whose main objective is to ensure the tax collection for an industry that in 2022 moved more than S/4,000 million.
This law, authored by Congresswoman Lady Camones, was promoted by the Association of Winemakers of Peru and the General Confederation of Workers of Peru (CGTP), institutions that were harmed by the original law because it granted advantages to foreign companies.
It is precisely these companies not domiciled in our country that move 70% of the money from the activity (some S/2,800 million last year, when the World Cup Qatar 2022). The promoters of the norm hope that the Ministry of Foreign Trade and Tourism (Mincetur), after promulgating the law, will also pre-publish the comprehensive regulation to receive opinions from all the sectors involved.
The ruling specifies that both companies established abroad as well as Peruvian companies that operate remote games and/or online sports betting in our country, are taxpayers.
The current law No. 31557 leaves online betting companies not domiciled in Peru without manifest regulation. Consequently, it requires that the guarantee be assumed by the winemakers who sell the bets and obliges them to have an exclusive space for it. In this way, more than 700,000 families are harmed.
From now on, with the modification approved by Congress, sports betting and online betting houses will all pay taxes equally, whether foreign or Peruvian, and this will result in greater income for the public treasury. In addition, it has been planned that a percentage will be allocated to the National Mental Health Program.
The autograph of the law was sent to the Executive power for its promulgation. The term expires on June 28. It is necessary to highlight that the opinion has the approval of the Mincetur, the competent portfolio for this purpose.
Finally, it should be noted that the approved standard is the product of the consensus reached among workers, winemakersbusinessmen and Mincetur, and that the National Parliament met this demand.
