What if they didn’t leave you a will, but in practice you’re a heir legal? The National Superintendence of Public Registries (Sunarp) recalls that, in the absence or invalidity of this document, the direct relatives of the person deceased —with hereditary vocation— can process an intestate succession to access the inheritance.
According to the agency, spouses, partners, children or parents can apply for intestate succession in the registry offices, through the use of the Digital Intermediation System (SID Sunarp) and the electronic presentation of documents that must have the digital signature of a notary.

Exceptionally, at the request and under the responsibility of the interested party, the notarial part may be processed by a person other than the notarywho will record the full name and ID number of the person who will be in charge of the processing.
What is the cost of intestate succession?
The registration fee for the registration qualification of the intestate succession is S/24, amount that does not include fees lawyersnotary expenses or costs for issuing or obtaining the documents prior to this stage.
Intestate succession: who can process it and in what cases?
According to Sunarp, the intestate succession can be processed in the following cases:
- When the will does not contain the names of the heirs.
- When the will is declared void by a judge. For example, when the person who made your living will suffered from senile dementia or mental deterioration.
From January to May of this year, 55,328 intestate successions have been registered. The three departments where the most declarations of heirs were registered are Lima (23,712), Arequipa (4,425) and La Libertad (3,923).
