He Supervisory Agency for Private Investment in Telecommunications (Osiptel) declared unfounded the two appeals filed by Telefónica del Perú against the lawsuits against it for failing to comply with the resolutions of the Administrative Tribunal for the Resolution of User Complaints (TRASU) and the corrective measures of Osiptel.
Thus, Resolution No. 014-2023-TRASU/PAS/OSIPTEL, which penalizes for alleged infringement classified in article 13 of the General Regulation of Infractions and Sanctions, is appropriate, for which reason the company must pay a fine amounting to 102 ITU (S/504,900).
It was also confirmed that Resolution No. 016-2022-TRASU/PAS/OSIPTEL is applicable, which punishes the operator for not complying with the corrective measures issued by Osiptel, established in article 25 of the General Regulation of Infractions and Sanctions.
In this way, according to resolutions No. 00152-2023-CD/OSIPTEL and No. 00154-2023-CD/OSIPTEL, published this Thursday, June 8 in the Official Gazette El Peruano, the appeals are declared inadmissible and Telefónica must pay a total fine of S/1 million 252,350.
