The proposal to reform the pension system of the Economy Commission of the Congress of the Republic points out that Peruvians upon reaching the age of majority will be automatically registered in a Pension Fund Administrator (AFP), which would nullify the possibility of citizens being able to choose between the public or private system; this was warned by the president of the Labor Commission, Sigrid Bazán.
“The Economic Commission proposes that when you reach the age of 18, you must necessarily register with an AFP and start contributing to the private system,” the legislator said yesterday. Before that, he also told the president of said working group, Rosangella Barbarán, by pointing out that it was “potentially unconstitutional” and that it should be re-evaluated.
Regarding the provision for a member to be automatically enrolled in a pension system, the economist and ESAN professor, Jorge Guillenexplained that the measure in his “regulation could have gaps and opens the possibility of unconstitutionality”.

He also recalled that all workers who enter the payroll today must decide between the 2 systems and if they do not decide, they are automatically passed on to the public, to the ONP, which has been considered by the AFPs as discriminatory.
But not only the aforementioned text is the one that has attracted attention, but also the inclusion of measures such as allocating a percentage of the General Sales Tax (IGV) for pensions, when experts who appeared at that work table stated that technically it was not feasible.
“There is no evidence of a country in the world that has implemented such a system”, said the economist and professor at the Universidad del Pacífico Noelia Bernal at the time.
In addition, a State contribution equivalent to that of the member is being considered.
Integrated system
On the other side, there is the opinion approved in the Work Commission, which was officially presented yesterday. Among the main novelties that it brings is that no pension, neither disability nor survival, would be less than the basic basket of individual consumption (S/430); they would be integrated into the 2 current pension systems and universal basic pensions would be created.
This model is supported on 3 pillars: for workers with income greater than S/5,125 whose contribution will be 9% (complementary); dependents and independents will contribute as well as the State and the employer (contributory); and social, financed only by the State for people over 65 years of age or with absolute and permanent disabilities (non-contributory).
“Now the debate will be much more enriching, but I think it has to be based on who benefits or is affected, because what I see from the other proposals is that they simply seek to improve the conditions of the private sectors,” he said.
