He Executive power promulgated the rule (Law No. 31763) that modifies the Consumer Protection and Defense Code (Law 29571) and states that the entities of the financial and insurance system in all their offices nationwideThey must resolve the claims within a period not exceeding 15 business days.
Thus, paragraph 88.1 of article 88 of Law 29571, on claims for products or services, is changed. It is also mentioned that for exceptional cases, the Superintendency of Banking, Insurance and AFP (SBS) may establish an extended term when the nature and complexity of the operation, product or service that is the subject of the claim justifies it. “This situation must be brought to the attention of the consumer before the end of the initial term, without prejudice to the consumer’s right to appeal directly to the Consumer Authority,” the regulations specify.
It should be noted that this law enters into force 60 business days from Monday, June 5. In this line, the SBS also has a period of no more than 30 calendar days from the publication of the law to issue a necessary complementary regulation or adapt existing ones for the effective application of the modification.
