Fonavi: they propose to start the returns in July

The Technical Secretariat of the ad hoc Commission has proposed to start with the returns of contributions to the National Housing Fund (Fonavi) in July of this year, prioritizing those who have received nothing to date. While those who were part of the 19 lists will receive an amount of money again in November, they confirmed from the National Federation of Fonavistas and Pensioners of Peru (Fenaf-Peru) to the Republic.

What stage are they in?

While the secretariat continues to identify the contributions of each exfonavista, the ad hoc commission must approve the guidelines to make the return of the money operational.

The entrapment today is that the members representing the Executive Power allege that the almost S/2 billion that the commission has in equal parts must be returned to the 1.8 million retirees, because “it is difficult to determine the contributions of each because companies, both in the public and private sectors, do not have that detailed information”.

For their part, the fonavistas They agree as long as they are allowed to accredit more contributions, which would correspond to a higher figure.

“We accept the formula, but if you create the space for the fonavista to accredit the information. If a recalculation is made and if there is a differential, it is returned to you. Or the other, parts the formula. Where it is outdated currency (sol de oro and inti), you apply a criterion to give it to everyone equally, but where we have current currency (nuevo sol), you use the legal interest that the Constitutional Court sentence tells you”, explains Jorge Milla, member of FENAF-Peru.

According to the latest sentence of the TC, the State debt is only subject to what the workers contributed. According to the most recent calculation, which dates from 2021, the amount is S/6,800 million, but if it is updated to date, it would amount to S/7,000 million.

A necessary background to remember is that the contributions of the workers were 0.5% of the remuneration between the years 80 and 88, since then and until 1992, it reached 1%; while in 1993, it rose to 9% for 10 months and then dropped to 3%. For that reason, the fenaf points out that for returns to be fair, they must account for all these variations.

It should be noted that from 1980 to 1993 the collecting entity was the Banco de la Nación and accumulated S/992,000. While from 1994 to 1998 the National Superintendence of Customs and Tax Administration was in charge (Sunat) and collected S/42,000 million, which is the amount currently in dispute.

Consequences of the sentence

The recent decision of CT It also brought other headaches to the Fonavistas, since it establishes that the debt update formula is based on legal interest, which would reduce the value of their contributions to zero, especially when it comes to amounts in sol de oro or intis. Consequently, he harms the most vulnerable workers.

The Sunat updates its debts with the Consumer Price Index. In other words, they can do it, but they can’t pay off the Fonavi debt. There is an inconsistency there between the magistrates,” Milla said.

The commission It met yesterday, but when an agreement was not reached, the session was suspended again until next Thursday, June 1. The next step is for the decision they make to be published in a supreme decree to start the payments.

The numbers

  • S/2,000 million are available to give back to the fonavistas.
  • 800,000 have not received any amount to date.
