Fonavi: Congress seeks to adjust the law to start with partial payments

Yesterday, the Economy Commission of the Congress of the Republic voted unanimously in favor of adjusting the Law no. 29625 so that the ad hoc Commission can start with the return of the money to the ex-contributors to the National Housing Fund (Fonavi), because he has almost S/2,000 million in his account for that purpose.

In October 2022, the ah doc Commission was installed with the aim of establishing the guidelines to return the money; However, to date, payment cannot begin because the Ministry of Economy and Finance (MEF), which is part of said working group in majority, maintains that the law does not allow the issuance of certificates of recognition of contributions. and rights (Cerad) partial, but for the total amount.

In this way, the representatives of the Fonavistas sought through the Legislature to adjust Law No. 29625 and allow partial Cerads, which would also make possible the distribution of the additional S/50 million that the Executive has allocated from this year’s budget to pay the full debt.

In addition, the approved opinion, authored by the congresswomen rosangella barbaran (FP) and Noelia Herrera (RP), includes recognizing the right to return to the heirs of deceased workers, indicating that, when the amount to be reimbursed exceeds S/19,800 (4 UIT), the legal regulations in succession issues.

While, when the sum is less than 4 UIT, it is only required to present the documentation that proves the hereditary condition of the beneficiaries. The initiative must be debated and approved in plenary for its official promulgation.

The Commission will resume today the session that began this Tuesday, where seeks to define the contribution of workers in a way that does not harm them, since the last sentence of the Constitutional Court indicates that these amounts should be updated to the legal interest, which would reduce the contributions “to zero”. The National Association of Fonavistas and Pensioners of Peru (Fenaf Peru) seeks to take the Consumer Price Index (CPI) as a reference.
