They seek to put limits on the collection of debts through workers’ salary accounts

the congresswoman Norma Yarrow, from the Avanza País bank, proposes establishing limits for banking entities regarding the collection of direct debts from the accounts of the workers in which they receive their remuneration in order to protect their basic needs. Currently, if a user has a credit card and a salary account at the same financial institution, and the user is late in paying the first, the institution can collect from the second.

PL 4939, presented on Wednesday, May 10, states that article 87-A should be incorporated into Law 29571 of the Consumer Protection and Defense Code to provide a viable solution to this problem: “The compensation referred to accounts in which the remuneration of the consumer of financial services is deposited is not applicable when said amount does not exceed 5 Procedural Reference Units (URP). The excess can be compensated, but only up to a third”.

In this way, if the user’s remuneration is not greater than S/2,475 (5 URP), it cannot be affected by charges. In return, if you exceed this amount, you may be compensated, but only up to one third.

“As there are no limits on the part of financial institutions to operate the compensationthe consumer is placed in a state of violation of their rights, even more so when Indecopi itself issues contradictory decisions, evidencing a lack of uniformityreason for which, in view of the diversity of criteria of the regulatory entity, it is necessary to go to the court to conclude if the compensation on the remuneration accounts ends up affecting the user consumer”, the document indicates.

The proposal is already in the Consumer Defense and Economy commissions for evaluation and opinion, then it can go to the Plenary of the Congress of the Republic for debate and voting.
