Today is the deadline for the CTS deposit: how to report and how much is the fine if your company fails to comply?

This Monday, May 15, the deadline for micro, small, medium and large companies deposit your workers Compensation for Time of Service (CTS), labor benefit that corresponds to the semester period from November 2022 to April 2023.

The Chamber of Commerce of Lima (CCL) remember that if you do not deposit this extra money within the established term will be considered as a serious infraction. For this, the National Superintendence of Labor Inspection (sunafil) may apply differentiated fines, depending on the type of company, which range from S/544 to S/129,294. To determine the amount of the fine, in addition to the sector to which the company belongs, the number of affected workers is taken into account, considering the UIT as a base, equivalent to S/4,950 during 2023.

In addition, the worker must know that within five days of making the deposit, your employer must give you the settlement sheet with which the calculation of the CTS. If you do not do so, you are committing a minor infraction, the fine of which ranges between S/222 and S/76,824.

CTS: what to do if my company still does not deposit me?

After the maximum term, if the employer has not deposited the CTSthe employee has the right to file a virtual complaint before sunafilentity in charge of supervising the correct compliance of the deposit.

  • Select the labor regime 728which means that it is in the private sector.
  • Insert the number of RUC of the company.
  • address of workplace to denounce.
  • Documents that support your complaint, such as pay stubs, employment contract scanned and in PDF format.
  • place your personal informationsuch as personal cell phone number and address.
  • Add the matters to denounce and select your complaint as appropriate: CTS deposit.

CTS: can the money be withdrawn?

Workers should know that, according to Law 31480have the option to withdraw 100% of their funds from their account until December 31 of this year CTS in order to cover the economic needs caused by the COVID-19 pandemic.
