Reform of Law 28832: the die in Congress would be cast for renewable energies

The modification of the Law 28832 of energy efficiency, which promotes a greater participation of wind and solar energy to lower electricity prices for 31 million Peruvians, will have a second chance this Tuesday, May 16. However, and as La República was able to verify, there is no way, at this time, that the vote can change.

The commission is made up of 21 parliamentarians. On Monday the 8th, the total vote on the ruling issued in PL 2139, 3662, 4565 and 4748 ended with 9 votes in favor, 8 against and 1 abstention. After the request for reconsideration —which would be seen this Tuesday in an extraordinary session—, we will unravel the opportunities.

they voted for favor to include wind and solar energy in the tenders for the regulated electricity market, the benches of Acción Popular —through Jorge Flores Ancachi and Illich López Ureña— and Perú Libre —through Margot Palacios and Segundo Montalvo—. However, in the latter, the vote of Alfredo Pariona was missing, who acts as secretary of the working group and opted to abstain.

Likewise, the support of the Magisterial Bloc is counted —through Elizabeht Medina and Segundo Quiroz—, as well as the solitary votes of Luis Kamiche, of Peru Democracy, and the former member of Peru Libre Jorge Ccoayla, now in Peru Bicentenario. That is to say, all the benches of the left.

The votes in against they belonged to Avanza País —through Diego Bazán and Diana Gonzales— and to the Renovación Popular bench —through Jorge Montoya and Miguel Ciccia—, in addition to the solitary vote of Rosio Torres, from Alianza para el Progreso.

In the case of Fuerza Popular, a group that votes en bloc, the die is cast. To the contrary votes of the incumbents César Revilla and Héctor Ventura, the accesitarios Eduarco Castillo and Hernano Guerra García are added.

These two took the place of Luis Cordero Jon Tay and Jorge Morante, both on leave, although the latter has stated on more than one occasion his rejection of a bidding model that equates hydroelectric and thermoelectric plants with renewable energies. As for Jon Tay, he is involved in an investigation for espionage.

Law 28832 of renewable energies falls

Three votes missing: Carlos Zeballos Madariagafrom Podemos Peru, and Eduardo Salhuana, from Alianza para el Progreso (its bench has already announced its rejection through Torres), both on leave. He didn’t pay either Carlos Alva Rojasformer head of the working group.

Four votes in total at stake, including the one that abstained. The Republic contacted three of them and the response was not positive. Parionafrom Peru Libre, will now vote against, after having “reconsidered his decision” to prevent the arrival of greater “Chinese monopolies” in the electricity market.

“I understand that this project favors Chinese companies, I have discrepancies and I will support my position next week, in which the reconsideration is seen (…). This law apparently wants to support the population, but they could be affected by this monopoly”, assured the parliamentarian for Huancavelica.

Then we have Zeballos Madariaga, who said that he was on leave from the Energy and Mines Commission because that same day he had to be in other working groups, such as Zero Hunger. However, he made his position clear.

“If we implement these renewable energies, they can enter at a good price but at some point it can become more expensive. If we do not have rapid depreciation, then it would be bland and would not favor the population. They will compete with normal generation companies,” he said.

Zeballos was the one who showed a little more optimism regarding the law proposed by the Executive and assured that, with the proposed modifications, the negative vote of the Alliance for Progress could vary, expressed for the moment only by his partner Rosio Torres. However, at the moment they do not intend to do so. His license followed two meetings with farmers and miners in Madre de Dios.

“In the Executive project, worked on by a special commission, too many articles have been incorporated that distort the initial objective, that is why we have our objections to this bill. I think that if what is indicated is corrected, we could reconsider it,” he said. the legislator.

Finally, Alva Rojas did not answer the call from La República. However, the count of hard votes from the right and left blocs, as well as the early announcement of those absent at the last meeting, suggests that The electricity market that supplies Peruvian families will continue to be at the mercy of hydroelectric and thermoelectric plants, without the possibility of including new players that will push prices down.
