Unanimously, the Consumer Defense Commission (Codeco) of Congress approved the opinion of insistence that seeks to prohibit spam calls for commercial purposes. This occurs after the Executive Branch observed this proposal because, it maintains, it could affect the freedom of enterprise.
“It is false or extremely improbable that free enterprise is affected, given that this activity of the so-called call centers It has not been prohibited, therefore, this Commission considers that, above the right to free enterprise, is the right to health of the human person,” said Elías Varas, president of Codec.
This way, Parliament’s working group did not collect any of the Government’s observations and insisted on the initiative, which must be approved in plenary session of Congress.
“The autograph is protecting the most important right enshrined in the Constitution of Peru, such as the right to defend the human person and respect for their dignity, since in this way their peace of mind will be returned to the human being by preventing them from receiving spam communications, unwanted communications that alter their lives, as they interrupt hours of rest , family, work, special moments and many others, even putting their personal security at risk, due to the insistence of these communications,” said Varas Meléndez.
Likewise, the parliamentarian specified that the autograph observed has respected the provisions of Law 29733, which protects the personal information and indicates that there must be consent from the user for the processing of data.
“From the reports and statistics prepared by the special center for the monitoring of consumer complaints of Indecopi, one can appreciate the high degree of dissatisfaction that exists on the part of users regarding spam calls, having as alleged cases of communications without consent, mainly, Telefónica del Perú SA, with 3,439 reports, and Entel Perú SA, with 1,716, while for the financial and insurance sector, the BBVA bank stands out, with 885, and Scotiabank, with 827,” he said.
