MEF considers it “highly probable” to sue the new ONP recognition bond before the TC

It is being evaluated to file a claim of unconstitutionality before the law promoted by Congress on pension matters, said Minister Alex Contreras.

Alex Contreras, holder of the Ministry of Economy and Finance (MEF) He pointed out that it is “highly probable” that Law No. 31729, which updates the recognition bond and was promulgated this Thursday, April 27, will be sued before the Constitutional Court (TC).

“Right now the teams are analyzing and working on it, I cannot advance the position of the MEF for now,” Contreras said during the presentation of the Macroeconomic Projections Update Report (IAPM). “But, it’s highly probable taking into account that we have observed the law and that it has been approved at the insistence. With high probability we are going to file a claim of unconstitutionality, ”she added.

The recognition bond law will transfer the contributions of affiliates who moved to the AFPs since 2002 and was approved at the insistence of the Congress of the Republic. However, the MEF has observed the measure and, previously, has indicated that its position is contrary to this norm due to the fact that, from the portfolio, they presented a pension reform proposal.

It should be noted that the MEF has a term of no more than 12 months to issue and establish requirements for the transfer of this economic contribution. Thus, from April 2024 the transfers would begin to be made.
