Artisanal fishermen demand enactment of the law that protects the 5 miles

10 days have passed since it was approved in the Congress of the republic the law that seeks to prioritize artisanal fishing within five miles, in addition to other modifications to the General Fisheries Law that will contribute to a necessary fisheries management for the sustainable exploitation of resources. However, according to the Legislative website, the autograph has not yet been sent to the Executive Branch for promulgation.

For this reason, 31 representatives of union organizations of artisanal fishermen from the Peruvian coast have signed a letter addressed to the president Dina Boluarte requesting that you promulgate the proposal as soon as possible. They also warn that the Federation for the Integration and Unification of Artisanal Fishermen of Peru (Fiupap), whose main representative is being investigated for illegal trafficking in scallops, is spreading false information regarding this law.

This historic law protects the five miles for the true artisanal fisherman, whose activity is characterized by manual labor. Therefore, (1) it prohibits industrial vessels within this zone; and (2) prohibits bolichitos, mechanized purse seine vessels of up to 32.6 m³, in the first three miles to avoid the depredation they cause. With the aforementioned law, we finally feel recognized!, since our demands of yesteryear are being met,” they point out in the document.

It should be noted that the National Fisheries Society (SNP) has spoken out against the rule because it ensures that the possibility of establishing an exceptional fishing regime in the south of the country is closed, establishing the reduction and exoneration of fines administrative in the fishing sector, among other reasons. For their part, civil society organizations specialized in fishing issues have denied these claims.

The initiative was approved on April 12, 2023 in plenary; After that, it must be sent to the Executive, which has a period of 15 working days for its promulgation or observation. If after the term the regulation has not been published nor have there been observations, the president of the Congress may order its publication in the Official Gazette El Peruano.
