Arequipa: Majes II continues adrift due to discrepancies

The Majes Siguas II project is adrift due to the problems that arose in the delivery of land for the construction of its components. The Autonomous Authority of Majes (Autodema) indicates that it complied, but Cobra insists that the properties are not released. In its letter No. 243, the concessionaire indicates that “from the documents in reference it is inferred that the grantor is not in a position to deliver all the land necessary for the execution of the works,” she says.

In addition, Autodema accuses it of lack of diligence before the term that Cobra has requested for the analysis of all the documentation related to the control of the project. “Requiring between 2 to 3 additional weeks to evaluate the documentation (…) is out of any contractual consideration,” he says.

Autodema accuses Cobra of non-compliance by not receiving the land. Meanwhile, the letter indicates that the private company refused an extension to comply with the delivery of land that will be access to the Lluclla intake. But, he adds that an alternative route has been delivered with almost zero interference that will not affect the company at any cost.

“There would be no reason for Cobra to say that the land has not been handed over. The company does not seem to have the will to continue with the project. The regional government should not let itself be stepped on,” said regional councilor Fernando Cornejo.

According to Autodema, the land was delivered physically for the first phase on April 11 and also for the second phase on the 12th of the same month, but the concessionaire did not attend both appointments.

They ask Cobra not to go to arbitration

In a statement from the Chamber of Commerce and Industry of Arequipa (CCIA), signed by its president Julio Cáceres Arce, urges the concessionaire of Majes Siguas II not to resort to international arbitration. They also request the intervention of the Ministry of Economy and Finance (MEF). The private entity also proposed establishing a technical dialogue table between the GRA and Cobra to seek solutions to all disputes.
