Through Resolution No. 0076-2023/SEL-Indecopi, published in El Peruano, the Ministry of Labor and Employment Promotion (MTPE) is not empowered to curb the economic activity of insurance brokers despite “regulating regarding social benefits.
In this regard, they recalled that the only entity competent to regulate the performance of insurance brokers is the Superintendency of Banking, Insurance and AFP (SBS)which establishes the obligations, rights, guarantees and conditions in which they must carry out their work.
“In this sense, the questioned bureaucratic barrier turns out to be illegal because, by imposing it, the aforementioned ministry has exceeded its powers,” the court said. indecopi.
