Internal Work Regulation: from how many workers is it mandatory in companies?

The Ministry of Labor and Employment Promotion (MTPE) reminded all companies with more than 100 workers that are obliged to have a Internal regulationsregardless of their type of employment contracts.

The ministry specified that this document must be made known to the worker when he enters to work, and its preparation will be the responsibility of the company. “The regulations will include all those directorial, administrative and technical provisions that are necessary for the fulfillment of the obligations of the contracting parties in the labor relationship,” he said in a press release.

It should be remembered that through Supreme Decree No. 039-91-TR and complementary regulations, it must be taken into account that the main provisions that regulate labor relations are the following:

  • Admission or entry of workers.
  • The days and hours of work, time of the main feeding.
  • Work attendance control rules.
  • Rules of permanence in the position containing: permissions, licenses and absences.
  • Modality of weekly breaks.
  • Rights and obligations of the employer.
  • Rights and obligations of the worker.
  • Rules tending to the promotion and maintenance of harmony between workers and employers.
  • Disciplinary measures.
  • Person or agency in charge of dealing with labor matters and their processing.
  • Elementary standards that must be observed within the development of the work activity, in order to protect hygiene and safety at work, and indications to avoid accidents or other professional risks, as well as the respective instructions for providing first aid.
  • HIV/AIDS prevention standards.
  • Implementation of lactary.
  • Employer actions regarding its personnel with tuberculosis.
  • The other provisions that are considered convenient according to the activity of the company.

The MTPE is the competent authority before which employers must submit the request for the approval of their Internal Work Regulations. Once the regulation is approved, this document must be made available to workers within five calendar days after approval.
