Indecopi determined that the prohibition of the sale and consumption of alcoholic beverages near churches is a bureaucratic and illegal barrier.
It is worth noting that the Provincial Municipality of Huaraz established that liquor may not be sold within 100 meters of the perimeter of religious temples through article 9.1 of municipal ordinance No. 148-MPH.
However, Indecopi maintained that said municipality has established a prohibition that has not been determined by article 3 of Law No. 28681, a measure that regulates the commercialization, consumption and advertising of alcoholic beveragesTherefore, it is illegal.
Nor does it appear in article 6 of Supreme Decree No. 012-2009-SA, which approves the regulations of Law No. 28681, in which they only establish this restriction near educational institutions, but do not contemplate churches. Thus, they conclude that the Provincial Municipality of Huaraz exceeded the current regulations.
