SBS dissolves 4 credit unions due to inactivity

The Superintendency of Banking, Insurance and AFP (SBS) declared this Friday, March 31 the dissolution of four savings and credit cooperatives (COOPAC) for being involved in the cause of inactivity.

Thus, through Resolution SBS 01051-2023, published today in El Peruano, the dissolution of the Alto Selva Alegre Savings and Credit Cooperative is declared. In addition, Alex Eduardo Condori Nina and Víctor Luis Ríos Cucho are appointed as temporary, principal and alternate administrators, respectively.

Meanwhile, Resolution SBS 01052-2023 dissolves the Jesús Obrero-Comas Ltda. Savings and Credit Cooperative No. 092 and appoints Carlos Enrique Montesinos Cáceres and Anabel Nagai Huillcahuaman Cuchillo as temporary, principal and alternate administrators.

Similarly, Resolution SBS 01053-2023 declares the dissolution of Integrar Savings and Credit Cooperative. In addition, Roberto Fiestas Jiménez and Ana Roxana Sánchez Meza are appointed as temporary, principal and alternate administrators.

Finally, Resolution SBS 01054-2023 dissolves the Cooperativa de Ahorro y Crédito Finanzas Mypes Perú Ltda., and also places Ingrid Vanessa Escobar Ramírez and Leslie Maxciel Escobar Farfán as temporary, principal and alternate administrators.

Restrictions on dissolving cooperatives

The legal provisions indicate that COOPACs declared in dissolution are prohibited from:

  • Initiate judicial or administrative proceedings against you for the collection of credits at your expense.
  • Pursue the execution of judicial decisions issued against you.
  • Create liens on any of your assets as collateral for the obligations that concern you.
  • Make payments, advances or compensation, or assume obligations on her behalf, with the funds or assets that belong to her and are in the possession of third parties.
  • Constitute a precautionary measure against their assets.

Functions of temporary administrators

Temporary administrators will have the functions detailed below:

  • Register the resolution that declared the dissolution of the savings and credit cooperative in the corresponding public registry.
  • Take immediate possession of all the assets of the COOPAC in dissolution, order that the titles, securities, contracts, books, files, as well as any other document and whatever belongs to it be delivered to them; as well as sign the minutes containing the transfer of these assets.
  • Prepare, from the beginning of the dissolution process, the statement of financial position, the statement of income and other corresponding comprehensive income, in accordance with the pertinent provisions issued by this Superintendency.
  • Arrange for an inventory of all the assets of the COOPAC in dissolution, including the corresponding supporting documents.
  • Arrange for the valuation of all COOPAC assets in dissolution.
  • Prepare the list of creditors of the COOPAC in dissolution, indicating the amount, nature of the claims and preference they enjoy, in accordance with article 10 of the Regulation of Special Regimes.
  • Maintain the liquid resources of the COOPAC or companies with multiple operations of the financial system classified in categories “A” or “B”, according to the regulations in force on the matter.
  • Receive from the partners the amortizations and/or cancellations of the credits granted and services rendered, as appropriate.
  • Continue the actions for an effective and timely recovery of the credits granted by the COOPAC in dissolution, as well as for the collection of reinsurance and coinsurance, if applicable.
  • Carry out the necessary actions to formalize the guarantees granted to the COOPAC in dissolution and lift said encumbrances after canceling the debt or entering into a judicial or extrajudicial transaction, whatever the case may be.
  • Deliver possession of all the assets, books, files and other property documentation of the COOPAC to the liquidator appointed by the Judiciary, when appropriate.
  • Carry out other administrative and labor acts that need to be resolved as part of the COOPAC administration.
